um well, I would say it could go both ways....

If the counselor and advocate are friends, the counselor may be more willing to listen to what the advocate has to say.

I would just take a wait and see hopeful attitude

If things dont go the way you think they should I would talk to the advocate about there possibly being a conflict of interest.  First and formost your advocate is a professional.. give her a chance to show you that.

I'm Glad it all finally worked out.. Stay on 'em though and make sure they follow through on what they say they will do.

ARE  YOU KIDDING ME???  I cannot believe they told you that! If he has a disability at the VERY minimum he can have an ARD they need to listen to your concerns, see the diagnosis of ADD, and then decide if an IEP is warranted or if accomodations are needed under section 504.

Something needs to be done at that school... I hope you give em  you-know-what!!

The Advocate from Pluk, called me and we are having a meeting maybe tomorrow or Wednesday. 

I told her I am really surprised that school has never called me,  She said, they are trying to figure out a way to cover there butts.

I was like OK, I will see you tomorrow.

It is shameful that your son is failing b/c he is not getting the support he needs.  My son has the smarts too, but if there were not people there to help him get jump started he would be failing too.  There are so many kids in this situation.

B/c he is capable of doing the work, he probably won't be eligible for an IEP, but he definitely would be able to get on a 504 based on his disabilities and his current school performances.  A 504, written correctly, will get him the support he needs.

You did great by getting an advocate.  I had to get an advocate too.

ARD stands for Admission, Review and Dismissal.

It is a meeting between the teachers, parents, counsiler and any other party interested in the education of the student.  It primarily has to do with Special Education -- whether a child needs to be Admitted to the Special Ed program, a review of the students progress in Special Ed or of objectives obtained in the Individual education plan ( IEP) or Behavior Intervention Plan ( BIP). It is also there to determine whether the student can or cannot be Dismissed from the Special Education program after he or she demonstrates that he or she is performing at a level that is even with his or her IQ.

An ARD can be requested by the teacher or by the parent. BTW, an admission to Special ED does not necessarily mean a pull out program.. any student who has an IEP in the regular ed classroom is identified as being in the special Ed program, and can be given accomodations such as preferential seating ( no adder should be allowed to sit in the back of the classroom! Too much opportunity to tune out! -- my ADD kids sit front and center so I can see if they are zoning or not.), extra time on tests, minimized distractions, and shortened assignments to name a few..

I need to tell you that I have never sat in on an ARD. But I have a notebook full of literally HUNDREDS of IEPs in my desk that I am required by law to look through so that all my students can be successful.

I am hoping for a little help from a person named moe, to fix this.Smile

Chandler got the program that I wanted him to be in.  So thru all this crazyness over the past few days.  It worked he finally got in.  Not sure of this Advacote thing, suppose to meet Monday, she finally called. I am kind of mad at her she is friends with she-devil.

I am sorry to say, Folks:

The system has failed, the counselor has turned on the Math teacher and says, no studyhall with homework is available for my son not unless the TEAM, four teachers and the counselor, decide to vote him in.  We are Military, and are ousted in this community we live in.  Even though the Military is the largest employer in this town, if there were no military here then the town would collapse. My husband has been in for 18 years and they have no schools on base you use city schools, so they can get our funds.  Everything is going south and I am not doing as well as last night.  Thank you all for your support.

I got a letter thru e-mail today, from the school district.  Of course, I told him what I thought.

I called the State Department of Education, so I will see where this goes.

Maybe the guy will have a relative or friend at the school.  Who knows, Only moe does. Ha....

i always did fine at school so i don't know exactly how it feels to
not make it.   but if he fails - what happens? does it matter? will
he be forced to stay down a year or something?

at my school, we had complete 'thickos' (as they were cruelly
called) but they never had to stay down a year. they just
plodded on in the bottom stream --- and often enough ended
up surprising everyone.

one girl, Miranda - she wasn't allowed to do the Oxbridge exam
(that is one that qualifies you to go to Oxford or Cambridge).
the school actually would not LET her sit the exam --- which
was ridiculous because so what if she failed kinda thing (but i
think it might impact their own statistics if they have X many fail
Oxbridge they go down in the league tables). so normally only
people in the top two streams could apply for Oxbridge and she
was in the fourth/bottom stream.

anyway, so she deferred a year before going to University and
applied and took the Oxbridge exam on her own - in her year
off. and was accepted to Magdalene College!!!
HAHAHAHAHA! she went and shoved that right in their face
back at my school.

but the point i was trying to make is that she had been a failing
student her entire school history --- right up until the last year.
when she just turned it around.

and really, in England (it might be different in the States) it is
entirely irrelevent how well or badly you do in school until your
last year of A'levels --- which will affect which university you go
to.   the rest of your schooling (if you are not kept down a year -
can be either terrible or wonderful and it doesn't matter).

if your son is getting sick with anxiety - i would tell him. it just
doesn't matter. i don't care what results you get. just do your
best and we'll celebrate no matter what. just for getting through
them and trying your best.

Iam going to e-mail Psm about school related issue. 

My child is in the 7th grade, nearly 13. 

He can do the work, he just needs guidance.  Last night he passed his hunter safety test here and only missed 5 questions.  But, then again, he really loves hunting. 

He won't get held back for the no child left behind law.  School, where my son goes flunked to keep up with the standards of no Child left behind.  So that should tell you something. 

There view is he passed is state exams last year, so we don't care if he gets F's or D's he can only have a regular study hall.  The math teacher told me yesterday, that he has so many behavioral problems in the class room that son is not getting the attention he needs.  He hasn't noticed anything in regards to medication, because he has not been a problem.  I have no idea what the hell I am suppose to do. If all else fails I will be repeating the 7th grade with him. 

I can just see the newspapers headlines "40 year old repeats 7th grade and wears patch for no smoking laws, in school." I just have to laugh. Smile That is all I can do is laugh and get thru this.

College is just to far away to even think about.....Thank you for your concern.

the other thing i had to do was call EVERYONE from principle, school psychologost, teacher, speach therapst, and so on and so  forth trust me i pissed off everyone EXCEPT the school social worker who is trying his hardest to help me and my child....

i dont know where u live u can pm me that as the advocate emailed me about a meeting next saturday that i should go to just have no way to get there and i  could see if there is such a thing in ur area...

if your son doesnt have an iep and they wont referr him for one...request one in yourself as they have so many days thereafter to test him....

I have had it.

Did you know when he was sick on Thursday is because he was up puking all over my carpet at 03:00 in the morning, Thinking he was not going to beable to pass the Shop test, and wanted to drop the class. No kid, should have so much anxiety...they puke on the carpet and are unable to make it to the bathroom.

I am totallyOuch But, at the same time have to keep my head up and laugh at this.

He is ADHD, can only take long acting Concerta.  He has a mood disorder, anxiety and depression brought out by Adderall, and he could have other issues that the Dr. has not yet diagnosed because of his age. He can not take fast acting meds at 04:00 because it is to much for his system.  That would really throw his system out of wack.  I don't think I should have to raise his trileptal to counteract fast acting meds.  He may actually need the extra dosage  that he has left on the trileptal one day for a real real real emergency, and not homework issues.

I definitely agree that you are entitled to an IEP. His anxiety about his class shows that this isn't a simple matter of not trying hard enough. He deserves a little extra help if he truly wants to succeed, and I have no doubt that he does. You already know what I think on the meds...

I believe that with the new IDEA 2004 in effect, a school has to take into consideration all the resources the parents are using to enable a child to succeed. That is to keep them from denying services to a child in need simply because the parents have been seeing that the remediation is done.

You have the right to request a meeting and, at that meeting, list all the things you have done to help your son. Make sure that you can give them a close estimate of the time you spend volunteering in school to work with your son. Tell them how much time he spends on homework and list the way he will vomit before a test and any other physical reactions he has to school and school work. If anyone else is helping or has helped him, list that. They have to be made to see the need for proper remediation, accoms, etc, for him.

These sites all have articles explaining IDEA 2004. I think they all have articles telling you how to use it to get what your child needs.

If you have to hire a private advocate to go to the meeting with you and to help you get him help, it would be worth it. They are quite expensive.

The only thing I can do is laugh.....laugh.....laugh..... I mean it that is all I can do with that much medication you would think he would be atleast a B student or better. 

No, not at my son's school, they say, he doesn't need any extra help.  He is a good and compliant child.  That's because he is on meds.... Angry

I actually have to go to the school and help him finish stuff in the ISS room because the teachers donot have time to help him. 

For example:  Today was the shop class, he had to pass a safety test, the teacher told my son he was suppose to correct the questions he got wrong and write the question and answers 5 times each.  He never circled which ones he was suppose to do.  My son corrected the wrong questions, Monday, Tuesday, Wednesday and Friday in ISS.  I went to the class on Friday afternoon, and asked the teacher exactly what he needed to do.  We got this done in 15 minutes.  My son lost 4 hours of class time, to write 2 questions and answers 5 times each. Which really concerns me power tools and a safety test.  You would think that the teacher would help and make sure he understood, for god sakes.

I saw the Math teacher after school and he told me well it looks like he got a 55% on the Math test.  I told him well I am not surprised one bit, if he doesn't have all F's in all his main core classes.  He just looked at me, I told him nobody helps him.  I have done everything I can do, and I am not staying up until 11:00 and fighting about homework.  (I have also met with the school district, teacher, counselor, physcologist, principle)  They all told me he would have help.

I have begged that school to let him be in a study hall that helps you with your homework and they said, he doesn't qualify.  Because, he passed his state test last year.  Well last year he was on 30 mgs of Adderall XR, sure he passed, but he came home and crashed on me like a Maniac. This year he is on Trileptal and Concerta 27mgs. Half the dose of Adderall XR.  I swear the only thing I can do is laugh.  Smile

Plus his Shrink sent a letter also asking for help.

I did call a organization called Pluk, here in Montana.  They told me it was against the Montana Public School Laws for someone to be sent to ISS, over not being able to correct a test, he did nothing wrong.  Except the teacher never did his job. He needed a little guidance and he doesn't get it in one class. I e-mailed the Counselor on Tuesday for help and I have yet to get a reply.

The Pluk organization is going to Advocate for me. Thank god.  I e-mailed that counselor and told her to set me up a appointment. Will see if she responds now.

Any other suggestions? By the way he can do the work, he just needs more guidance with directions.  He would pass then. I just have to quit working at the school for free.  Eventually they have to come thru, they have to.

Does your son have an IEP? ( Individual Education Plan?)

If not, you have the right as a parent to request an ARD ( Admission, Review, and Dismissal)

one purpose of the ARD is to work with parents and teachers to come up with a plan to help the student be successful in school. If they are written in his IEP, teachers would be required BY LAW to follow the IEP to the letter.

Accomodations could be things such as shortened tests, more time on tests, and yes STUDY HALL, if he has ADD he qualifies to get that help under Federal law.

check out IDEA ( Individuals with Disablities Act) Although I hate to call ADD a disablity, it qualifies as one under IDEA.

If the school will not work with you, I think it would be about time for legal counsel... they have no right to deny appropriate accomodation in the least restrictive environment.

There is a new board about school and ADD that I havent visited thoroughly yet. ( I'm an ADD adult and somehow my kids didnt inheiret that from me) There is most likely a lot of information there from parents and teachers who have more experience with this. Good luck!

it costs them more for an iep screening but you hae a right to request it in writing and they have to do it within so many days depending on your state laws...send the request in writing by mail so they have to sign for it for proof that they got it.....

You made me laugh.. No child left behind law, is they have to pass certain standards of test or they don't get funding from the government from the school. Atleast that is how I think it goes. 

So they are spending time with the ones that didn't pass last years exam to make up for it. 

So my child, is ousted with any disabilities he may have and maybe next year they would catch up to him after they don't get funding for him.  It is a crock of you know what!

If you ask for the IEP screening, the correct way to ask is for a complete education evaluation. Make sure you say that you think he has learning disabilities and want them to check for them. Tell them you want a prior written notice if they refuse. Its the law that they send one, but they won't if they think you don't know about it. They hate them.

Send the request in writing, return receipt requested. Keep a copy for your files. Send it to the district head of special ed, not anyone at the school. You can send copies to certain ones if you want to.

They will have 60 days from the receipt of your letter to complete testing.

I think I have found some help at least I hope, Ok, now get this, I had called this group on Friday for the NAMI group, I don't even know really want they do.  But, tell you what this MOM said, the right thing at the right time. 

Anyway, he asked me who I was and so on. So this is the best part, I told him about shop class, I told him about the Math teacher and what I told him, I was totally honest. 

Turns out the man was FRIENDS with the MATH teacher, he is calling him right now.

The man from NAMI called back, and told me he spoke to the Math teacher and they are NOW going to get him into the STUDY Hall that helps with homework!!!!!!!!!!!!!  It will take a week, But, Guys I think I got it.
