Some gifted children are misdiagnosed as ADHD because, to put it simply, they are bored! You didn't make it clear whether that is the case. Make an appointment with the school psych and find out just where he stands. Ask them what they intend to do to help him. If he is advanced and still not making it, that is their problem. If he knows the work and is still falling behind, again that is their problem. They are not meeting his educational needs.
After you have talked to the psych, write a letter requesting a 504 to address the problem of his inability to stay on task long enough to get his work done and pass. Send it return receipt requested so you have proof they got it, also keep a copy for yourself. You need to hold them accountable. Most teachers will find a way to help a child stay on task and if he is so bad that she can't manage that, she needs to give him accommodations that allow him to show he knows and can do the work but cut out any unnecessary work. It sounds like he may be failing because of uncompleted work and the resulting zeros rather than not knowing it.
If that isn't the case, please explain the exact situation. I believe we can help you come up with some accommodations that would help him and make the teacher's job easier.

IMac38945.8914467593Sarah, there isn't enough information for me to form an opinion.
Sometimes parents get confused when a school suggests that a student
needs some outside help and believe that a school can dictate what that
help is; they can't, but there are circumstances where a school can
refuse to teach a child.
Hi, it has been a rough week my son who is 6 was falling behind in reading so the school told me he had to be put in after school homework program 1 hr 3 days a week we are on our 4th day and he got kicked out and his primary teacher also is the teacher for 2 days of his after school program and she told me that she is "done " helping this kid.
His school has done all the tests for an IEP and the schools special team just came back and said ther findings are that he is very advanced in all academics including reading but he lacks attention span and the ability to stay on task also gets easily distracted.
My concern is that the teacher is no longer willing to help him and is there any legal thing that they can do to force us to medicate him?
Also i dont know if this is normal for ADHD or not but Andrew goes to bed at 8pm and is asleep by 9pm but is ready to start the day at 4am this is something that is vey new only been going on for about 2weeks , doc said give him Benedryl to sleep but he sleeps he just doesnt stay asleep and when we gave him Benedryl he fell asleep right away but woke up 1am and wouldnt go back to sleep.
To answer your question, NO the school cannot make you medicate your son.
I also would not recommend Benadryl for a long term sleep solution..... has he been diagnosed? Is he on any type of treatment for ADHD (I assume he is not on meds due to your question)?

My 8 year old is also an early riser. The teacher can not just "kick him out" of her class. I'd be up at that school and complaining first thing in the morning. i would also call a few school board members (if you know any) to let them know how this teacher has cast him out. The teacher has to have some sort of behavior patterns she can enforce. And if you don't choose to medicate, you really should check out the alt med board on here. But, faced with similar problems, I chose to medicate. But that is a VERY personal and hard decision to make. I would take it up with your child's dr and with the school.

grrrrr- I would march straight up to the principal and EVERYONE else I could get near and make sure that teacher was DONE with her job!

The more i think about this, the more mad i get. If i were you, I'd be calling the principal right now. I would also email the teacher and cc all the school officials (principal, superintendent, councilors and board members) and tell them what is going on. I would be irate!!! your choice to not medicate is none of her business. and if she is imposing on you to do so, she needs to get a new job that doesn't involve teaching children.
they can suspend or expell students with behaviour problems.
Is there a behavior problem here too? Or is she just po'd because you won't do it her way?
What a shame that she feels a 6 year old is not worth helping...
I agree that this situation angers me the more I think about it... she should not be allowed to teach if this is her attitude.
