Pos Drug Test & Disability Status | ADHD Information

Just curious if any one knows the answser to my question - I took a pre employment drug test that came out positive (Dextrostat). The HR department asked me about the circumstances of why I was taking it &  I had to tell them the reason for taking the drug (ADD).  They ended up hiring me anyway.

Since ADD is considered a disability - do you think that I am now labeled an employee with a disability?  Would HR be required to have notified my immediate supervisor with this information?

 

 

 

No, HR is supposed to maintain confidentiality unless you actually request accoms.  They will count you anonymously for whatever ADA stats they have, but you control who knows - aside from HR. 

Ideally you can take your prescription bottle with you before you pee in the cup.  They will then do whatever to your testing results to indicate it is not positive for illegal drugs - without the employer asking directly.

SORRY but no, you don't.

The person taking the urine sample does not need to know what you are taking. Neither does a company HR Department....No matter what they say.

The only person that you EVER talk to is the Medical Review Officer (MRO) when and IF you have a positive result. His/Her name is on the Chain-of-Custody that you get a copy of. If you have a legitimate script for that sustance, the MRO will report you as NEGATIVE to the HR department. That is all they need to know.

Confidentiallity laws are there to help you.

downsmith38862.8555902778Yes add and adhd are a disability. Employers have to hire so many minority groups. If not it is considered discrimination. When I had a urine test they asked what meds i take in the last 30 days I tell them so if comes out positive they know the why. Many things test out the same also.

With HIPAA now in place. You should not do that. That information should only be between you and the MRO.

If they ask what drugs you are taking, they do not need to know. Whether they are trying to intimidate you or are ignorant, they should not ask you that.

Your employer only needs to know you have a disibility if you want accomodations for it.
