IEP/504’s help me also! | ADHD Information

I've been viewing the message boards for a while and am so glad I've found this website.  I have a wonderful 8 year old DD who was diagnosed by a child psychiatrist at 5 years old with ADD.  She is also showing behaviors of Asperger's syndrome.  I've questioned my DD's school principal about getting her a 504 to help her with classwork.  DD is not concetrating inclass and therefore is not able to do homework at home or if she does it takes hours sometimes.  The teacher is telling me that they go over the material in class but DD is not listening.  But because she is testing on reading and math well the principal says that DD's cannot get a 504 plan.  They recommeded her getting a formal evaluation for ASperger's and then they would get her a classification as "Other Health Impaired".  I spoke to a child psycholgist that DD is seeing for Asperger's and she said that our school board's policy on ADD/ADHD is that it can be "taken  care of" with medication.  My daughter is already on Concerta 36 mgs daily.  Is it true that it is at the school's discretion whether a child receives a 504 or IEP?  I am truly at my wit's end and my daughter is too.
