NO! No school system has a right to force you to medicate your son. However, if your son is disrupting class, fighting or being a behavior problem, they can threaten to suspend or expel him and if he gives them cause to, they will. It's basically "you have to do something to control this kid or he'll get expelled." They can't force you to give him medication and they can't report you for not giving it. If your son presents a problem, they CAN kick him out of school.
What kind of normal "boy stuff" does your son do? Do other kids his age act the way he does? Does it cause a problem for other students and teachers when he does this "boy stuff?" Have you told him that this kind of "boy stuff" seems to upset the teachers and can he please not do it?
My ds's first grade teacher told me after 4 days that ds had ADHD and needed to be on ritalin. She's not a doctor and therefore can't diagnose or prescribe, so she got into trouble, but....I wish I had taken her more seriously. I kept telling myself that ds was smarter than all those other kids (he's very smart) and was just bored and the material wasn't challenging him. I ignored her and we switched classes and had a teacher who knew him and knew what he was like. He did ok, since grades at that age are based on what the teacher knows the kid knows, not what the kid actually can demonstrate that he knows. It wasn't till 2nd grade when a teacher told me after some classroom problems that she wasn't saying ds had ADHD, but if it were her child, she'd want to find out what the problem was.
So go to your pediatrician and get a referral to a doctor who specializes in childhood ADD/ADHD. A neuropsychologist is best, but insurance is sometimes a problem. Get a workup done and a diagnosis. The pediatrician taking your word that your ds has adhd and the school will report you if you don't give him meds isn't a diagnosis. This workup will also reveal if your son doesn't have any problems. Whatever you do, don't NOT deal with it. There would be no excuse for that.
You might see if the doctor will give you a note that states stimulant medication was ineffective has been discontinued on medical advice, and that the child is being refered for further assessment. This can sometimes get them to realize they are not really part of the medical care of your son, so they can move on to the other things that can be done to help your son at school.
While you are getting a thourough assessment, start the IEP process at school for a behavoir plan (not behavior contract, but behavior plan). This should be done to make sure the child's difficulties are not due to environment and make an environment that is most condusive to his learning. As susieb has expained, the school has recourse (expulsion, moving him to a different school, etc.) if the things your son is doing is interferring with the education of others.
vickie39100.6844212963I absolutley didnt want my child on medication for ADHD, it was the schools prompting, that made me finally go to the doctor and get medication for my chid. I have decided not to give it to him because there is no difference. My son is a normal boy and does normal boy "stuff". I have been told there is a threat they may report me for non-compliance of medciation. Stimulants are not life sustaining drugs, its not like Im not giving him a much needed heart medication. Can they do that?????
