You said she told her therapist that her dad has hit her.  Has she told the therapist of any other incidents of abuse?  I'm sure the therapist has documented all of it .That needs to be brought to the court's attention.  It's a good arguement for supervised visitation at the very least.  Find a good lawyer (your county court system should be able to refer you to a pro bono lawyer if you cannot afford one) to take to court with you.  It will make a difference.

It also might help to have the therapist testify about the trauma that this causes her, and if the therapist beleives that your grandaughter is being abused in any way that should have a lot of weight with the court.

Has she been back to her dad's since she tried to hurt herself?  That is a very serious thing, especially in a child so young.  What were the circumstances at the time- do you know how closely she was being supervised at the time, and if you don't mind my asking, what was the extent of her injuries.  Also, did she herself tell the hospital staff that she hurt herself, or did her dad?  I'm sure the hospital would have done a screening for abuse if there were any suspicion, but it wouldn't hurt to check with the hospital to see.  Unfortunately I do know of an instance were a child was hospitalized with "self inflicted" injuries, only to have it come to light later that it was actually the parent, and he had threatened the child to make him lie and say he did it to himself.

I am so sorry that you and your family are going through all of this turmoil!  I am afraid that I have no legal advice for you, as I am fortunate enough to have never had to deal with the court system in regards to my children, or anything else for matter.

I did however want to lend my support and let you know that you are in my thoughts.

Is the concerta helping her in her school hours and while she is at your home (not her dad's)?  I am sure that no matter how well the med works for her while she is in her home/school where she is comfortable, it will most likely not help her at her dad's home.  If she is so unwilling to go, and dislikes being there, that setting will most likely continue to be problematic, but it sounds like her dad does not want to be helpful, so a solution to that is probably not happening any time soon.

I hope things go your way at the court hearing and your grand daughter can find some peace...
