I would just send a letter stating that you are not clear on why the plan was modified without your knowledge, but that you look forward to the agreed upon plan being adhered to. Then file grievances or whatever method that you use in Canada, fighting the suspension, and copy the teacher so she knows that failure to adhere to the plan lead to the suspension.

After weeks of struggle, my husband and I agreed to a specialized education plan for our 5 year old that we didn't necessicarily like, or agree with.. but worked. He's doing much better in school and after 3 weeks with no complaints, phone calls home, or suspensions.. we were willing to agree that perhaps it was the best thing afterall.. and got over the fact that we didn't like the plan..

Then without our permission, the teachers changed the plan. The resource teacher that was supposto be with him left.. because he was doing so well that they decided they didn't need her anymore. They pushed him back into all group activities and into situations that before.. got him into trouble.

Today.. I got a call saying that he was suspended again for 2 days because he hit someone.. again. "And how did this happen?" I asked? Well, during the chaos of getting ready to go home, he tripped and someone called him stupid and he punched him.

I'm not saying that him hitting is okay by any stretch of the imagination, but part of the plan that we hated so much.. but was WORKING.. was that he would get dressed to leave for the day in a different place than all the other children. No one asked me if it was okay to change that plan, and when put in a situation that he could fail in.. he failed. I'm appalled.

I'm mad, I want to punch the teacher myself for being so stupid. If their main concern was getting him out of situations where he could explode and hurt someone, then WHY did they put him back in it and suspend him for 2 days?

But I suppose I should be greatful... they're not going to enforce the school policy that says " Any student that has been suspended 3 times for more than 2 days will be expelled for the remainder of the school year"

Oh yes.. thankful.is the plan in writing? If so, I would definitely dispute the suspension. Call a meeting and get everyone back together and find out why the discontinued a plan they devised, and as you said was working. Diane V39434.6816435185

Is it an IEP? Or a 504? Neither can be changed without your knowledge and input. Did he have an educational evaluation ?

If it is an IEP they violated IDEA, and you have grounds for a state complaint, if it is a 504, it is an OCR complaint.
