Your school is playing hard ball. Get in the game and hire an education advocate before things get out of control. You need serious help--too much for the board. If you don't have a comprehensive evaluation from a neuropsyche outlining recommended classroom behaviors, testing, etc, do it NOW. Yes, this will cost -3k, and probably won't be covered by insurance. Also, send a written request for a functional behavioral assessment via a certified behaviorist and use the frequency of suspensions and denial of FAPE as your reason. You need to do these things immediately.
I am reading that according to federal laws, a child with an IEP can be suspended for 10 school days. after 10 days, a school board hearing must be held. Do In-school suspensions count and is this 10 consecutive days or 10 days through out the school year? My son has been suspended 3x's totally 10 days in the past month. All of the behaviors were attributed to his adhd. I have asked for placement in a special ed classroom but it was denied. His behavior has escalated and the teachers are showing 0 tolerance. I understand he is depriving others from their education but his progress report came home w/ straight f's. He before had b,c,d's; never an F. I attribute this to him always being in the office of suspended! Can anyone clear up the rules. I have an IEP meeting this week, and I want to be prepared.www.wrightslaw.com your best source for IDEA and FAPE.
