I wanted an evaluation for my son just to see if the prior eval. were correct. his insurance would'nt cover this so it cost me 0.00. it was'nt a dr referal I called and made the appointment. So josh has adhd and prevasive delopmental disorder so change is hard on him. and I found out he did'nt take his adderall that morning, so his behavior was not great. so i think the eval. person who was only a resident had gotten angry by his behavior so when she went over her findings which were about the same as prior tests, she said she'd send me the report, and my son's pediatrician. I don't want my son's dr getting her biased opinion. Is there a way I can legally tell her I do not want it sent to his Dr?Hey there. Did you already ask her to not send it? What did she say? She may be legally obligated TO send her results to the doctor. I don't know if you have any legal recourse but you can explain the situation to his doctor and ask him to make sure to take into account what the circumstances were when you had this evaluation. Hopefully, your son's doctor can be objective and keep an open mind.
No, as she was saying these things i was processing this and never thought about it. I just wonder since the dr did'nt refer him and had no knowledge we were going there why would she send a report if i did'nt want it sent. After all I paid for the evual. with the hipa laws you'd think i should be able to block it.
Yes you can. Unless you authorized your son's medical records to be shared or released, its confidential and illegal to share such information with anyone. There are circumstances whereas the doctor could share but under very limtied circumstances which I doubt exist in your son's case. Read on:

Confidentiality covers all medical records (including x-rays, lab-reports, etc.) as well as communications between patient and doctor, and it generally includes communications between the patient and other professional staff working with the doctor.
The duty of confidentiality continues even after patients stop seeing or being treated by their doctors. Once doctors are under a duty of confidentiality, they cannot divulge any medical information about their patients to third persons without patient consent. There are, however, exceptions to this rule but information can only be shared agaisnt the patients will under very limited circumstance.

kj, check your pm box Well, I would think that since there was no doctor referral, that she wouldn't send it but did you give her your doctor's name? Did you sign any release forms? Sometimes in all that fine print, which i never take time to read, it tells you want can or will take place. if you didn't sign any release forms then you probably don't have anything to worry about. and if you didn't give her your doctor's name then i don't think you'd have anything to worry about there either.
however, you may want to consider sharing with your doctor that you had this evaluation done.
i did give the drs name when i made the appt. because i was asked who gives him his adderall. i'll call and see if that does any good to block it. i wish i had a oh theres a law stating this when i called.Unless you signed a release, I don't think can send the report on.
i never signed anything. i wonder if i should call the dr or if i should call and ask for a person in charge.
