I have raised a son who is now 23 and ADHD. At that age we ran into the same problems. The child is not covered under the ADA, but he is covered as an EH student. This stands for Emotional Health if he is found to have learning Disabilities.
Right off hand I can't remember the Act that covers this, but there is one. It has to do with educational disabilities.
Under this they have to provide him with certain amenities, i.e. extra study time, verbal tests. They have to make reasonable accomodations for the student. I also don't know the background, but isolation because he wouldn't write his name seems extreme. Parents and teachers need to pick their battles wisely and some of these battles are so petty.
The other thing that you might want to do is have him evaluated outside of the school. Our school said he wasn't ADHD he was just a difficult child. We had him tested outside of school by a psychologist and he is severly ADHD. Also if your school doesn't have this program they fudge on the evaluations, because they have to send him to a school that does have it and they have to pay for the transportation.
Do not back down, it is your childs well being at stake. If you do not continue the fight things will definitely get worse has the child grows older. Take care of business now.
You may also start with behavior modification at home. Give him some chores to do that are fit for a 6 year old, but have consequences if they are not done.  They need to learn at an early age for every choice there is a consequence.

Is this school or prison? Does your teacher understand what is going on with this child? Is she doing anything to educate herself how to handle him? He's only 6, how much trouble could he possibly get into that would be grounds for expulsion?

Waiting for those tests (I''ve waited for them as an adult) can be a living nightmare, and the test administrators DO NOT understand. It is simply their job to assess and evaluate the child's responses to the test to make sure he has the disorder. This means that time is of no consequence to them. They're getting paid to do this and they do not have to care that the waiting period is too long. These tests were not developed with the ADHD (or AS or bi-polar) person in mind. They were developed for children with impairment that was limited to academic performance, not social or behavioral, and who could wait a little while for a diagnosis because all other aspects of their life went smoothly, even successfully.

My just turned 6 year old son, has 1 more change in kindergarten and then if he acts up again he will be exspelled!!! 

Can they do this??

he is in a regular class room and not accepted in special services until they finish testing him....

what rights do i have to make sure they cant exspell him??

He has been in isolation dince monday and then today they let him come back in until he refused to write his name, so now he is back in isolation until next wed, is this extreme why for 3 days a pop..they think he has other disorders adn the school is testing him so why are they going to exspell him?

Please give me advise, i plan on fighting this so i need to know where i need to start and what i should do up until today they were working with us trying to help him where can i find out what rights he has??

My 12 year old son has been expelled from school and is being charged for making a bomb threat.

He has zero history with the law or for getting into trouble at school

all of his current behavior is ADHD and he has been diagnosed by a doctor

They put him back in isolation for refusing to write his name!?

The school is, I believe, supposed to take the fact that he is suspected to have a disability and is being tested for it and act as though he had it when it comes to matters of discipline.  I'll try to find the laws regarding it.

If he is having so many problems, write to the school and either send it registered or e-mail. This is important as it is the only way you can legally make the school respond. Keep a copy for your records.

Ask them to give your son a 504 while they are waiting for the test results. Ask them to send you a Prior Written Notice if they choose to deny him the 504. That is also important. It forces them to look at many different aspects of his situation and to explain why he doesn't qualify in each of them. I think it is like 14 different points. Also, if the testing they are doing does not include a behavioral assessment, request that they do one with the intent of creating a behavioral intervention plan.

He qualifies because there is a significant discrepency between what he is doing and what he should be doing and it is causing him severe problems in a major life area. It does not have to be educationally related for him to qualify.

A 5 year old should be recieving help to learn to live with others, not isolated from others.

Yes, ADHD can qualify as a disability under OHI or Other Health Impaired. You would need to contact an attorney for the specific ways you can have him identified and use it to help him.

Try contacting the ACLU if you can't find an attorney. If they can't address it, they should be able to help you find an attorney in your area.

The school feels that the actions leading upto and after him writing a bomb threat were

not related to ADHD I hope to get soem sort of legal help to get him back in school and out of and real legal trouble has anybody had this happen to them? and what did you do?

Even though your son may not qualify under a 504 plan he might under

 IDEA 2004 Individuals with Disabilities Education Act (IDEA 2004)

The wrightslaw site has a ton of stuff including a directory for each state for where you can get help.

You may be able to get your son in a private school that can better serve his needs and get he school district to pay for it including door to door transportation.

Good Luck don't give up! I have a 14 yr old son whom I fighting for too. He a great kid but needs and deserves more than the school can give.
