As far as I see it you earned you vacation pay by working there for 4 years, I would certainly fight for whats mine!
thank you....i guess i'll start with getting note from my doc and sending it to ex work...see where that gets me
I would get the vacation pay!! It is my understanding it is against the law. The timelyness in which the pay you is a different story. They may be able to deduct some for not giving the notice, not sure how the law works......I'm not sure where you are at - but a friend here in canada went through a somewhat similar withholding of holiday pay.
Here - probably where you are too - the employer is REQUIRED BY LAW to hold 5 to 7 percent of your income as a vacation fund. It's in a bank account - and belongs to you just like a damage deposit or any other withheld income.
When my friend was let go - the boss tried to make it sound like there simply was no money to give! The government quickly cleared it up with my friend and she went down looking for money or blood! Thankfully - the money came forward keeping my friend from certain jail time! lol
I would check with your government labour authority (will be a section of your phone book dedicated to government agents) on the legality. If the government agent says fork it over - guess what happens next?
Most important - don't let it slide. I used to as well. It's the easiest route and one all us ADHD'ers want. None of us want hassle as it makes us anxious.
Take the step of getting legal backing (the phone call). It will make it feel less anxious. Get them to help you if they are capable!
Good luck on this one :)
In the US, Vvacation pay is earned. When you leave a company. No matter what the reason, thecompany must pay you for the vacation time. You are not obligated to give notice. Opena claim with your state's labor department. You do not need to say why you left. Simply say "For personal reasons." formyson38544.213287037
If you can afford it, I would consult an attorney--depending on how much your vacation pay is worth.
There's no way you should be held accountable for not doing soimething that a medical condition left you unable to do. On top of that, my gut level tells me what they're doing is illegal. Vacation pay is not dependent on other performance factors. I think you're being conned and would certainly not just let it go. But an employment attorney would know for sure.
If you can't afford one you can do some Internet research and probably find out. If you're in the US, you should qualify under the ADA. Just threatening them with an ADA complaint may scare them enough to pay you. But don't let it go. It's not good for your self-esteem if you allow others to crap on you without standing up for yourself.
